Questions of "Who was there?" and "Who did what?": The Application of Code D in Cases of Dispute as to Participation but not Presence

Abstract

This note examines the application of PACE Code D where a suspect does not dispute being present when an offence was committed but denies any involvement in that criminal conduct. It is suggested that a consideration of the suspect population provides a logical basis for determining whether the Code D procedures ought to apply in particular circumstances.
