The introduction of terrorism-related offences in Australia: Comfort or concern?

Abstract

The terrorist attacks that occurred in the United States on 11 September, 2001 have profoundly altered the priorities of criminal justice systems around the world. The 9/11 attacks, together with the Bali bombings on 12 October, 2002 have led the Australian government to pass new laws concerning the interrogation, detention and prosecution of suspected terrorists. This article focuses on the broadening of domestic laws to criminalise a much broader range of conduct than ever before. The case of Zaky Mallah will be analysed to show how new terrorism-related offences may in fact be difficult to prove beyond reasonable doubt.
