Rationalising Recovery for Emotional Harm in Tort Law

That a person whose rights have been wrongfully infringed can, within general parameters, recover for the financial consequences of the wrong—i.e. the extent to which they are left “out of pocket”—is one of the most basic, and well-established, principles of tort law.
