Abstract
The call for an account of profits or other gain-based relief for breach of privacy is not new. Nonetheless, gain-based relief has only rarely been awarded for breach of confidence, and has never been awarded for breach of privacy, although it has recently been acknowledged as a possibility by the English Supreme Court in PJS v New Group Newspapers Ltd.
