Australian Climate Change Law after the Adani Coal Mine Case

Australian Conservation Foundation Inc v Minister for the Environment [2016] FCA 1042 is an important decision for Australian climate change law. The case concerns the Australian Environment Minister’s approval of the Carmichael Coal Mine and associated rail infrastructure proposed by Adani Mining, and raises the difficult issue of the extent to which downstream emissions and the impact of such emissions on climate change are relevant to environmental approvals.
