Scientific evidence and expertise have long been a feature of the international legal resolution of disputes raising environmental issues. Two of the earliest arbitrations in the history of international environmental law – the Bering Fur Seal Arbitration and its more famous arbitral cousin Trail Smelter – involved the consideration of scientific materials on factual questions.
