From the Heart: The Indigenous Challenge to Australian Public Law

Th e 2017 Uluru Statement from the Heart is an expression of Indigenous sovereignty. As the Statement explains, the ancient sovereignty of Aboriginal and Torres Strait Islanders ‘is a spiritual notion’ that has persisted for some 60,000 years as an ‘ancestral tie’ between the land and its peoples. Australian courts have closed their doors to this sovereignty and to any assertion of Indigenous law or jurisdiction that might invoke it. Likewise, the Constitution contains no recognition of Indigenous peoples’ status or rights, nor of their relationship with Australian governments.
